The tariff programme of US President Donald Trump has been a key focus of his second term in office. However, a case currently before the US Supreme Court could potentially disrupt this fundamental aspect of his trade policy. Trump contends that tariffs are a matter of national security and fall under the president’s jurisdiction, while others argue that they are an economic issue that should be determined by Congress, as outlined in the US constitution. The outcome of the Supreme Court’s decision could have significant implications for Trump’s tariff regime.

In a discussion with Jennifer Hillman, a law professor at Georgetown University and former general counsel of the US trade representative, FT senior trade writer Alan Beattie explores the potential impact of this case on Trump’s trade policies.
