It seems likely that the courts will uphold this lawsuit, and I predict that Trump will emerge victorious in this legal battle.
Pam Bondi Commences Crackdown on Sanctuary Laws
The Department of Justice has filed a lawsuit alleging that sanctuary laws in Chicago, Cook County, and Illinois have hindered federal efforts to enforce immigration policy.
It is my belief that the courts will rule in favor of Trump in this matter.
RedState has reported on the situation: There She Goes: Brandon Johnson, JB Pritzker Hardest Hit As Pam Bondi Begins Crackdown on Sanctuary Laws
Newly appointed Attorney General Pam Bondi wasted no time in issuing directives to “aggressively enforce criminal laws passed by Congress” and “vigorously defend presidential policies and actions on behalf of the United States against legal challenges.”
On Thursday, Bondi took further action by filing a lawsuit against Chicago, Cook County, and Illinois regarding their so-called “sanctuary” laws.
The lawsuit, filed in federal court in Chicago, marks one of the initial major cases initiated by the new administration’s Justice Department.
Bondi’s actions follow a request from House Oversight Committee Chairman James Comer (R-KY) for four sanctuary city mayors to testify at a hearing in March, with the objective of assessing the need for new legislation.
The mayors summoned to appear before the committee were Chicago’s Brandon Johnson, Boston’s Michelle Wu, New York City’s Eric Adams, and Denver’s Mike Johnston. Comer confirmed that all of them had agreed to appear at the March 5th hearing.
It is worth noting that both Johnson and Illinois Gov. JB Pritzker had practically challenged the Trump administration to take action against them, and it appears that they have now accepted that challenge.
Trump Administration Files Lawsuit Against Illinois
The New York Times has covered the story: Trump Administration Sues Illinois Leaders Over Immigration Enforcement
The lawsuit names Mayor Brandon Johnson of Chicago and Gov. JB Pritzker of Illinois, both Democrats, along with Superintendent Larry Snelling of the Chicago Police Department and other local elected officials in the nation’s third-largest city. This legal action is believed to be the new Trump administration’s first step in compelling state and local officials to provide more assistance in federal immigration enforcement.
The lawsuit argues that the lack of cooperation from local and state officials with federal enforcement of immigration laws has led to “countless criminals being released into Chicago” who should have been subject to deportation.
Illinois and Chicago have enacted laws to restrict their collaboration with federal agencies in deporting undocumented immigrants. The Illinois Trust Act, which prohibits local law enforcement from detaining immigrant prisoners without a court warrant, was signed into law in 2017 by former Gov. Bruce Rauner, a Republican.
Toni Preckwinkle, the president of the Cook County Board of Commissioners, who is also named as a defendant in the lawsuit, stated that the county’s policies “reflect our longstanding values and ensure that local resources are used to promote public safety and community trust. We will review the complaint and respond accordingly.”
Several immigration advocacy groups in Illinois recently filed a lawsuit against Immigration and Customs Enforcement in an attempt to prevent the agency from carrying out certain immigration operations in Chicago.
Trump DOJ Initiates Lawsuit Against Illinois, Chicago
Fox News has reported on the lawsuit: Trump DOJ Slaps Illinois, Chicago with Lawsuit Over Sanctuary Laws
The lawsuit, filed in Illinois against Gov. J.B. Pritzker and Chicago Mayor Brandon Johnson, among others, alleges that several state and local laws are “designed to and in fact interfere with and discriminate against the Federal Government’s enforcement of federal immigration law in violation of the Supremacy Clause of the United States Constitution.”
President Donald Trump declared a national emergency at the southern border on the first day of his administration as part of a series of measures to crack down on illegal immigration and bolster border security. The lawsuit contends that there is a national crisis stemming from illegal immigrants entering the U.S. and posing “significant threats to national security and public safety.”
“Further exacerbating this national crisis, some of these aliens find safe havens from federal law enforcement detection in so-called Sanctuary Cities where they live and work among innocent Americans, who may later become their crime victims,” the lawsuit states.
“Upon information and belief, the conduct of officials in Chicago and Illinois minimally enforcing—and oftentimes affirmatively thwarting—federal immigration laws over a period of years has resulted in countless criminals being released into Chicago who should have been held for immigration removal from the United States,” it adds.
Pritzker responded by stating that “unlike Donald Trump, Illinois follows the law.”
“The bipartisan Illinois TRUST Act, signed into law by a Republican governor, has always been compliant with federal law and still is today. Illinois will defend our laws that prioritize police resources for fighting crime while enabling state law enforcement to assist with arresting violent criminals,” he said. “Instead of working with us to support law enforcement, the Trump Administration is making it more difficult to protect the public, just like they did when Trump pardoned the convicted January 6 violent criminals. We look forward to seeing them in court.”
Anticipating the Legal Battle
“We look forward to seeing them in court,” said Pritzker.
Upon consulting my constitutional law expert friend about this case, he remarked:
This case will undoubtedly be intriguing. I am confident that the DOJ will emerge victorious. The federal government undeniably holds authority over immigration policy.
Despite the intense animosity towards Trump, particularly from some quarters, I am certain that the 7th Circuit, the federal Court of Appeals that governs Chicago, will rule in favor of the DOJ. The 7th Circuit boasts several highly competent judges.
Although the situation may be somewhat complicated due to the recent decision involving Texas, I believe that if the case reaches the Supreme Court, Justice Roberts will decisively resolve it.
Clear Path Forward
This reflects my stance when Texas faced challenges in enforcing immigration policy.
Although my prediction garnered criticism, it ultimately proved accurate.
With Biden no longer overseeing border matters, the tables have turned.
When I forecast the outcome of a court case, I base it on what I perceive will occur, not on personal desires.
While I anticipate Trump prevailing in this lawsuit, I advocate for a sensible approach. Mass deportations would incur significant costs. If Democrats were prudent, they would collaborate with Trump to reach a reasonable agreement.
