Reports indicate that Democrats are engaging in serious discussions about pressuring Supreme Court Justice Sonia Sotomayor to resign so that President Biden can nominate a replacement before President-Elect Trump takes office.

With the loss of their Senate majority, Democrats fear that Republicans will swiftly nominate conservative judges once President-Elect Trump assumes office, as reported by Politico.

Democrats are facing a critical moment and are considering whether to urge 70-year-old Justice Sonia Sotomayor to step down while they still have the power to confirm her replacement. This is not merely a hypothetical scenario but a topic actively discussed among Senate members.

According to Politico, Democratic senators have been discussing the possibility of persuading Sotomayor to resign, although there have been obstacles:

(1) It poses a risk at a time when Democrats are navigating a busy lame-duck session

(2) No senator is willing to publicly advocate for Sotomayor’s resignation

Previous attempts to remove Sotomayor were met with accusations of ableism and racism.

Potential replacements, such as D.C. Circuit Judge J. Michelle Childs and even Kamala Harris, have been mentioned as candidates to fill the vacancy.

On CNN, attorney Bakari Sellers proposed nominating Harris to the Supreme Court, drawing parallels to how Biden was replaced as the presidential candidate after a debate with Trump.

The plan carries risks for Democrats, including the challenge of confirming a replacement before the new Congress is sworn in.

Despite the logistical challenges, some Democrats believe focusing on confirming lower-court judges may be a more viable strategy.

Senator Josh Hawley has publicly stated that a last-minute Supreme Court nominee will not be confirmed before Trump’s term ends.
