U.S. District Judge William Alsup labeled the mass terminations as a “sham” tactic by the government’s central human resources office to avoid legal obligations for reducing the federal workforce.
Politico states that Alsup, a Clinton-appointed judge in San Francisco, directed various government departments to promptly rehire all dismissed probationary employees.
The judge criticized the Office of Personnel Management for making an “unlawful” decision to dismiss them.
This ruling is a significant blow to the Trump administration’s efforts to downsize the bureaucracy and is likely to be challenged.
“You will not bring the people in here to be cross-examined. You’re afraid to do so because you know cross-examination would reveal the truth,” the judge told a DOJ attorney during a hearing.
“I tend to doubt that you’re telling me the truth. … I’m tired of seeing you stonewall on trying to get at the truth.”
The judge referred to the move as “a gimmick.”
Alsup also pointed out that the Office of Personnel Management failed to provide guidance on who to terminate, as reported by ABC News.
“It is sad, a sad day when our government would fire some good employee and say it was based on performance when they know good and well that’s a lie,” Alsup remarked.
