Zillow says there is no evidence of ‘irreparable harm’ to Compass

Zillow Denies Compass’s Claims of Irreparable Harm

In a recent development, Compass filed a motion for a preliminary injunction alleging that Zillow’s policy enforcement would cause irreparable harm. Following an expedited discovery process, Zillow has responded, stating that there is no evidence of irreparable harm to Compass.

Zillow’s recent letter asserts that a hearing on the motion may not be necessary for Judge Vargas to make a ruling. According to the letter, Compass has not provided concrete evidence of irreparable harm.

Furthermore, Zillow refutes Compass’s claim that Zillow’s listing access standards policy hinders its marketing strategy. Testimonies suggest that Compass continues to implement its strategies effectively despite the policy.

The letter also mentions positive investor sentiment towards Compass, as indicated by a significant increase in the stock price since the policy enforcement. This contradicts Compass’s claim of confusion and concern among investors.

Zillow highlights testimonies indicating that the policy is not a significant risk to agent retention, further weakening Compass’s argument for irreparable harm.

Compass’s Antitrust Claims Fall Short, According to Zillow

In addition to denying irreparable harm, Zillow argues that Compass has failed to substantiate its antitrust claims. Zillow requests the court to potentially dismiss these claims to streamline the preliminary injunction hearing process.

Zillow contests Compass’s assertion that Zillow has a duty to deal with Compass on preferred terms. Testimonies suggest that Compass’s expert witness fails to address this issue adequately.

1Moreover, Zillow argues that Compass has not proven that the policy constitutes anticompetitive conduct, and Zillow could have achieved similar outcomes through less restrictive means.

As the supplemental brief deadlines approach, Zillow proposes filing short briefs to determine the necessity of a preliminary injunction hearing. Alternatively, Zillow suggests postponing the hearing to allow for adequate preparation.
