Over 10 million homeowners have been, or will be, notified that they may be eligible to receive compensation from the proposed commission settlements involving several real estate brokerages.
JND Legal Administration, the organization selected by attorneys to handle administrative tasks related to the commission lawsuit known as Gibson, has sent out more than 10 million postcard notifications to potential class members, along with over 27 million email alerts, since March, as indicated in additional legal documents provided by JND to Inman.
JND is also conducting advertising campaigns through print, TV, and digital media to reach out to consumers who may be eligible to file claims, according to the documents. These efforts emphasize the extensive nature of the settlements and their progression outside the courtroom.
PARTICIPATE IN THE INMAN INTEL INDEX SURVEY FOR JULY
The notice states, “If you sold a home and paid a commission to a real estate agent, then you may be part of class action settlements.” Already, more than 700,000 postcards have been returned as undeliverable.
Homeowners have until May 9, 2025, to submit a claim form by mail or through the website www.RealEstateCommissionLitigation.com.
Alternatively, they have until October 3 to opt out of the settlements or raise objections.
A final public hearing concerning the settlements by Compass, Real, Redfin, Realty One, @properties, Douglas Elliman, Engel & Volkers, HomeSmart, and United Real Estate is scheduled for October 31.
Not all brokerages mentioned in the Gibson lawsuit have reached settlement agreements, and the total settlement amount could increase in the coming weeks. EXp Realty is the largest firm that has not yet reached a settlement agreement.
Homeowners may be eligible if they listed their properties in the following areas and time periods:
- On an MLS in Alabama, Georgia, Indiana, Maine, Michigan, Minnesota, New Jersey, Pennsylvania, Tennessee, Vermont, Wisconsin, or Wyoming between October 31, 2017, and July 23, 2024
- On an MLS in Nevada between January 15, 2018, and July 23, 2024
- On an MLS in Arkansas, Kentucky, or Missouri between October 31, 2018, and July 23, 2024
- On an MLS in California between October 2, 2019, and July 23, 2024
- On an MLS anywhere in the United States, except in the states mentioned above, between October 31, 2019, and July 23, 2024.
Collectively, the brokerages mentioned above have agreed to pay over $110 million. The total amount exceeds $730 million when factoring in settlements from the National Association of Realtors, HomeServices of America, Keller Williams, and others.
Plaintiffs’ attorneys are entitled to receive up to 33.3 percent of the total settlement amount, in addition to any out-of-pocket expenses incurred during the case.
