AGs oppose HUD’s plan to roll back fair housing marketing rules

The Importance of Fair Housing Regulations

As the Trump Administration seeks to roll back crucial fair housing regulations, Attorney General Bonta emphasizes the significance of these protections in combating discrimination and ensuring equal housing opportunities for all communities.

The current housing crisis, fueled by a lack of affordable housing options, disproportionately impacts communities of color. It is essential for the Administration to recognize the importance of upholding the Fair Housing Act and promoting awareness of available affordable housing options to ensure accessibility for all Americans.

Under the Affirmatively Furthering Fair Housing Marketing (AFHM) regulations, owners and developers of HUD-subsidized housing are required to implement inclusive marketing strategies targeting protected groups such as race, color, national origin, religion, sex, familial status, and disability.

These regulations aim to prevent housing providers from selectively advertising to certain demographics, which contributes to the perpetuation of segregated neighborhoods. While landlords are not mandated to choose tenants based on specific demographics, they must demonstrate efforts to ensure inclusive outreach, especially in high-opportunity areas where protected groups are underrepresented.

Attorneys General from various states, including California, Maryland, and New York, have raised concerns about the proposed repeal of AFHM regulations. They argue that the repeal goes against HUD’s obligations under the Fair Housing Act and fails to provide a viable alternative or justification for reversing decades of policy.

In light of the increasing number of fair housing complaints reported by federal and state agencies, it is evident that the protection of fair housing rights remains a critical issue that demands attention and action.
